Totting Up and Driving Bans: How Failing to Identify a Driver Adds Points

A driver with nine penalty points may think carefully before risking another speeding offence, yet an overlooked letter can create a different problem. If a camera records an incident and the registered keeper fails to identify who was driving, the resulting prosecution can add points that bring a driving ban much closer.

An MS90 offence relates to failing to provide information about the identity of a driver when legally required to do so. For someone already carrying penalty points, this can have serious consequences because the failure to respond is treated separately from the original motoring allegation.

How the totting-up rules work

In Great Britain, drivers who accumulate 12 or more penalty points within a three-year period can face disqualification under the totting-up rules. The court will consider the relevant endorsements and the dates on which the offences were committed, rather than simply counting every point appearing on a driving record regardless of its age.

Consider a driver who already has nine points from previous speeding offences. A further offence carrying three points could bring the total to 12, putting the driver at risk of a ban. If a separate failure to identify the driver results in six points, the position could become considerably worse, even if the driver disputes responsibility for the original incident.

The exact outcome depends on the offences charged, the points imposed and the circumstances of the case. A driver should never assume that an unanswered notice will disappear or that points associated with an identification failure will replace those linked to the original allegation.

Why a missed notice can change everything

Official correspondence can be easy to overlook when you move house, share a vehicle with relatives or leave post unopened while working away. However, a notice requiring driver information may carry a deadline, and failing to respond can lead to a separate prosecution even when the original driving incident seemed minor.

The registered keeper should check the date, location and details of the alleged incident before establishing who had access to the vehicle. Calendar entries, work records and messages arranging a journey may help identify the driver. If another person borrowed the car, contact them promptly rather than waiting until the response deadline is close.

A request under section 172 of the Road Traffic Act 1988 generally requires the recipient to provide the requested information within 28 days, subject to the applicable legal requirements and circumstances. If you genuinely cannot identify the driver, make reasonable enquiries and keep a record of what you did. Simply claiming that you cannot remember may not be enough to establish a legal defence.

What happens if you already have penalty points

Drivers approaching the 12-point threshold should take any new allegation seriously. Six additional points for failing to identify a driver could push someone with six existing points to the threshold, while a driver with nine points could face a total of 15 if those six points are imposed and all the relevant endorsements count towards totting up.

A court can impose a driving ban once the threshold is reached, although the circumstances matter. A driver facing disqualification may be able to argue that a ban would cause exceptional hardship, but ordinary inconvenience, such as needing a car for shopping, is unlikely to be enough on its own. The court assesses the evidence presented and does not automatically grant an exception because someone relies on driving for work.

If you receive a court notice, read it carefully and obtain legal advice where needed. Gather your driving record, copies of the correspondence and evidence of any steps taken to identify the driver. If you believe a notice never reached you, explain the circumstances accurately and seek advice on the appropriate procedure rather than ignoring further letters.

Conclusion

Penalty points can accumulate through separate legal proceedings, which is why dealing with a driver-identification notice promptly matters as much as understanding the original allegation. For someone close to the totting-up threshold, a missed deadline can have consequences extending well beyond a fine.

Make a habit of checking post linked to your vehicle, keeping your registered address current and recording who borrows your car. If an official notice arrives, establish the facts and respond within the applicable deadline. Taking those steps early gives you a better chance of dealing with the matter properly before it threatens your right to drive.
